The Planning and Environment Court approved the extension of the 2007 development permit for the Biomass Power Plant until 20 March 2015.

The Court relied on the joint agreed opinion of the Queensland Department of Environment and Heritage Protection and of experts in town planning, air quality and noise that the permit be extended.

The Court found that Council had acted appropriately in raising public submissions against the proposal and noted that Council did not oppose the application.
